4. Quotations and Contracts

4.2 Contract Formation

A binding contract is formed only when:

  • We receive your signed acceptance of our quotation
  • We receive the agreed deposit payment
  • We confirm acceptance in writing

5. Payment Terms

5.1 Payment Schedule

Unless otherwise agreed in writing:

  • 25% deposit upon contract acceptance
  • 25% upon delivery of materials
  • 25% at mid-point of construction
  • 25% upon completion

5.2 Late Payment

Late payments may incur interest at 8% above the Bank of England base rate, as permitted under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Cancellation and Refunds

6.1 Consumer Rights

If you are a consumer, you have a 14-day cooling-off period under the Consumer Contracts Regulations 2013, starting from the date of contract formation.

6.2 Cancellation After Cooling-Off Period

Cancellations after the cooling-off period may result in:

  • Retention of deposits to cover costs incurred
  • Payment for work completed and materials ordered
  • Reasonable administrative charges

7. Warranties and Guarantees

7.1 Workmanship Warranty

We provide a 10-year warranty on our workmanship, subject to:

  • Proper maintenance according to our guidelines
  • Prompt notification of any defects
  • No unauthorised modifications

7.2 Material Warranties

Material warranties are provided by manufacturers and passed on to you where applicable. We will assist with warranty claims but are not liable for manufacturer defects.

8. Liability and Indemnification

8.1 Limitation of Liability

To the fullest extent permitted by law:

  • Our liability is limited to the contract value
  • We are not liable for indirect or consequential losses
  • We are not liable for delays due to circumstances beyond our control

  • War, terrorism, or civil unrest
  • Pandemic or epidemic
  • Government actions or regulations
  • Labour disputes or material shortages

11. Health and Safety

During construction:

  • We comply with all relevant health and safety regulations
  • Construction sites must be kept secure and access restricted
  • You must comply with any safety requirements we specify
  • Children and pets must be kept away from work areas

12. Planning and Building Regulations

Unless we specifically agree in writing to handle these matters:

  • You are responsible for obtaining necessary planning permissions
  • You must ensure compliance with building regulations
  • You must obtain any required permits or consents

We can provide support and guidance, but ultimate responsibility remains with you unless otherwise agreed.

13. Dispute Resolution

13.1 Initial Resolution

We aim to resolve any disputes amicably. Please contact us first with any concerns.

13.2 Alternative Dispute Resolution

If we cannot resolve a dispute directly, we may agree to mediation through a mutually acceptable mediator before pursuing legal action.

13.3 Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR and Data Protection Act 2018.

15. Amendments
